Terms and Conditions

§1. General Provisions

  1. The online store operating at loomonatural.com is run by: Przedsiębiorstwo Produkcyjno Usługowe Katarzyna Handschuh - Strugalska, with its registered office at ul. Poniatowskiego 15, 62-030 Luboń, Poland, entered into the Central Registration and Information on Business Activity (CEIDG), NIP (Tax Identification Number): 7811371395, e-mail: info@loomonatural.com, phone: 0048797490980.

  2. These Terms and Conditions define the rules for using the Store, placing orders, concluding distance sales contracts, delivery of goods, withdrawal procedures, and complaint proceedings.

  3. Sales are conducted within the territory of the Republic of Poland and abroad, including within the European Union.

  4. Minimum technical requirements necessary to use the Store and conclude a contract: a device with Internet access, a web browser supporting cookies and JavaScript, and an active email account.

 

§2. Definitions

  1. Seller – the entity specified in §1 section 1.

  2. Store – the online service run by the Seller at loomonatural.com.

  3. Goods – products offered in the Store which are the subject of a sales contract.

  4. Customer – any entity placing an order in the Store.

  5. Consumer – a natural person performing a legal transaction with the Seller that is not directly related to their business or professional activity.

  6. Sole trader with consumer rights (Quasi-consumer) – a natural person concluding a sales contract directly related to their business activity, when the content of this contract indicates that it does not have a professional character for them, resulting in particular from the subject of their business activity made available in the Central Registration and Information on Business Activity (CEIDG).

  7. Sales Contract – a distance sales contract for Goods concluded between the Customer and the Seller.

 

§3. Placing Orders and Concluding the Contract

  1. Orders in the Store can be placed 24 hours a day, 7 days a week (24/7) via the order form on the website.

  2. Information about Goods provided on the Store's website constitutes an invitation to conclude a contract within the meaning of Art. 71 of the Polish Civil Code.

  3. Placing an order by the Customer constitutes an offer to conclude a sales contract for the Goods.

  4. After placing an order, the Seller shall immediately send a confirmation of its receipt and acceptance for processing to the Customer's email address. The sales contract is concluded upon receipt by the Customer of the email message confirming the acceptance of the order for processing by the Seller.

  5. Provision of true and complete contact details is a condition for order processing.

 

§4. Prices and Payments

  1. All prices of Goods are given in Polish Zloty (PLN) and are gross prices (including taxes). Prices do not include delivery costs, which are indicated during the ordering process.

  2. The Store provides electronic payments through an external payment operator, Przelewy24 (including BLIK, fast transfers, card payments).

  3. The order is directed for processing after the Seller receives confirmation of payment credit from the electronic payment operator.

 

§5. Delivery

  1. Delivery is made to the address indicated by the Customer in the order form.

  2. Available delivery methods within Poland: courier delivery, parcel locker delivery (Paczkomat).

  3. The order processing time within Poland is 1 to 2 business days from the moment the payment is credited.

  4. In the case of deliveries outside Poland, the delivery date and detailed costs are calculated individually and indicated to the Customer before finalizing the order.

 

§6. Right of Withdrawal and Exceptions (Hygiene Goods)

  1. The Consumer and the Sole trader with consumer rights have the right to withdraw from the sales contract without giving any reason within 14 days.

  2. The period for withdrawal from the contract begins on the day on which the Consumer, the Sole trader with consumer rights, or a third party indicated by them takes possession of the Goods.

  3. To exercise the right of withdrawal, the Seller must be informed (e-mail: info@loomonatural.com) by means of an unequivocal statement. The statement can be submitted on the statutory model withdrawal form annexed to the Act on Consumer Rights, but this is not mandatory.

  4. The direct costs of returning the Goods shall be borne entirely by the Customer.

  5. The Seller shall refund the payment within 14 days from the day of receiving the statement of withdrawal from the contract. The Seller may withhold the refund until the Goods are received back or proof of their return is provided.

  6. Exception regarding hygiene goods: Pursuant to Art. 38 point 5 of the Act on Consumer Rights, the right of withdrawal does not apply to a contract where the subject of the sale is a good delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.

  7. Based on section 6 of this paragraph, the return of Goods of a hygienic nature (in particular underwear) is possible only on condition that the original protective packaging (foil/seal) has not been tampered with, opened, or damaged after delivery.

 

§7. Lack of Conformity of Goods with the Contract (Complaints)

  1. In the event of a lack of conformity of the Goods with the contract, the Consumer and the Sole trader with consumer rights are entitled to the rights resulting from the Act on Consumer Rights (Chapter 5a). In relations between the Seller and a Customer who is neither a Consumer nor a Sole trader with consumer rights, liability under statutory warranty for defects (rękojmia) based on the Civil Code is excluded.

  2. Complaints should be submitted electronically to the email address: info@loomonatural.com.

  3. The complaint should contain: the order number, a description of the non-conformity of the Goods with the contract, and the Customer's contact details.

  4. The Seller will respond to the complaint within 14 days from the date of its receipt.

  5. If the complaint is considered justified, the costs of repair, replacement, as well as documented costs of returning the defective Goods to the Store shall be borne by the Seller.

 

§8. Personal Data Protection

  1. The data controller of the Customers' personal data is the Seller.

  2. Personal data are processed solely for the purpose of processing orders and handling post-sale processes (returns, complaints).

  3. The Customer has the right to access their data, rectify them, delete them, restrict processing, and lodge a complaint with the President of the Personal Data Protection Office (UODO).

  4. Detailed rules for data processing are specified in the Privacy Policy available in the Store.

 

§9. Out-of-Court Dispute Resolution (ADR)

  1. The Consumer has the right to use out-of-court methods of resolving complaints and pursuing claims.

  2. A Consumer residing in the European Union may use the EU alternative dispute resolution (ADR) entities list to locate a certified body, available at the following web address: https://consumer-redress.ec.europa.eu/list-alternative-dispute-resolution-adr-bodies_en.

 

§10. Governing Law and Disputes

  1. Sales contracts concluded through the Store are governed by Polish law.

  2. The choice of Polish law does not deprive the Consumer of the protection granted to them under provisions that cannot be derogated from by agreement under the law that would be applicable in the absence of choice (the applicable regulations of the country of the Consumer's habitual residence).

  3. Any disputes arising between the Seller and a Customer who is neither a Consumer nor a Sole trader with consumer rights shall be submitted to the court having jurisdiction over the registered office of the Seller.

  4. In the case of disputes with Consumers and Sole traders with consumer rights, the jurisdiction of the court is determined according to general, mandatory provisions of law.

 

§11. Final Provisions

  1. The Terms and Conditions are effective from the date of publication on the Store's website.

  2. The Seller reserves the right to change the Terms and Conditions for important reasons (e.g., changes in legal provisions, changes in payment or delivery methods). For contracts concluded before the amendment of the Terms and Conditions, the version in force at the date of placing the order shall apply.

  3. In matters not regulated by these Terms and Conditions, the generally applicable provisions of Polish law shall apply, in particular the Civil Code and the Act on Consumer Rights.

  4. In the event of any discrepancies between the Polish and English versions of these Terms and Conditions, the Polish version shall prevail.
